Background re: Plea Agreements and Waiver Forms

If your attorney is unable to convince the Court or District Attorney that the charges against you should be dismissed, and going to trial or a contested hearing is not an advisable option for your case, it is not uncommon for a case to resolve in a negotiated “plea” deal, where your attorney and the District Attorney agree to a negotiated result.

 

In order to accomplish a plea agreement, you have certain rights that you give up that are described in a Waiver of Rights form. Any time you are giving up a right, it must be waived, and this can be done by signing a waiver form, which can also include such rights as the right to be present at every court appearance, or to appear with your attorney at sentencing.
